Personal Data Protection Information Notice
This Information Notice has been prepared by SBM Elektronik Para ve Ödeme Kuruluşu A.Ş. (briefly, the “Company”), acting as the Data Controller pursuant to Law No. 6698 on the Protection of Personal Data (briefly, the “Law”), in order to inform our valued Users and Representatives, in accordance with Article 10 of the Law, about personal data that may be obtained and processed during the execution of the activities and services provided by the Company.
Scope of Personal Data, Collection Methods, and Legal Grounds
Pursuant to the Law, Personal Data refers to any information relating to an identified or identifiable natural person. Your Personal Data may be collected, to the extent permitted by and within the limits set forth by the legislation, through various physical or electronic means, including but not limited to downloading applications offered on digital platforms bearing the names and brands of SBM Elektronik Para ve Ödeme Kuruluşu A.Ş. to your personal devices and/or using such applications online via our website; during the performance of services provided by our Company in the capacity of a Representative or while using the services of our Company; and in all other physical or electronic environments where you may be present, where legally required and, where necessary, with your consent, through databases of various institutions and organizations.
Purpose of Processing Personal Data
Your Personal Data is collected within the scope of Law No. 6493 on Payment and Securities Settlement Systems, Payment Services, and Electronic Money Institutions and the related secondary legislation, for the purposes of appointing you as a Representative and enabling you to carry out transactions on behalf of our Company; complying with domestic and international legislation requiring the collection, recording, and retention of transaction holder identity information; and preparing all records and documents that constitute a legal basis for the transactions conducted with our Company, through electronic channels or in physical (paper) form.
Transfer of Processed Personal Data to Third Parties
Processing of personal data refers to any operation performed on personal data, whether wholly or partially by automatic means or by non-automatic means provided that it forms part of a data recording system, such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making available, classifying, or preventing the use thereof.
Your Rights Regarding Personal Data Pursuant to Article 11 of the Law
Your Personal Data collected through the methods described above may be processed within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law, for the following purposes:
- Fulfilling information and document retention, reporting, risk monitoring, and information provision obligations imposed by domestic or foreign regulatory and supervisory authorities
- Conducting planning, statistical studies, customer satisfaction, and service quality improvement activities
- Preventing fraud and ensuring security
- Performing limit, intelligence, and suitability assessments related to the products and services you provide as a Representative
- Managing legal processes
- Fulfilling mutual rights and obligations arising from transactions carried out with our Company
- Communicating with you regarding products and services received or to be received
- Conducting product development, market research, and target customer group identification activities for our Company, business partners, and domestic or international affiliates
